An arrest is the act of apprehending and taking a person into custody, usually because the person has been suspected of committing a crime.
You can be arrested when suspected to have committed a crime as a result of a complaint against you or an investigation by the police.
Who can arrest?
The power of arrest is vested in the Police and other law enforcement agencies.
Private person(s) can arrest anyone he reasonably suspects to have committed an offence.
Owner of a property can also arrest anyone committing an offence involving injury to his property.
Where arrest is made by Individual or owner of a property, the person should hand over the suspect to a police officer or the nearest police station without delay.
NOTE:
- A person cannot be arrested in place of a suspect
- A person cannot be arrested based on a civil matter or breach of contract
How to Make an Arrest
A suspect should be accorded humane treatment with regards to his ‘right to the dignity of his person’ and not subjected to any form of torture or degrading treatment.
A person arrested should not be handcuffed or subject to unnecessary restraint except:
- By an order of a court
- Where there is reasonable apprehension of violence
- Where there’s an attempt to escape.
